Article 1 – Purpose
These general terms and conditions of sale and use apply to all tickets giving access to the various activities offered by the COMPANY. The language of the contractual documents is French.
Article 2 – Ticket
Any person wishing to access activities must hold a TICKET. The TICKET issued is strictly personal, non-transferable and non-transferable. All TICKETS entitle the holder, during their period of validity, to free circulation on the leisure center activity(ies) for which they were issued, without any priority of any kind whatsoever. The TICKET must be kept by the TICKET HOLDER for the entire time allocated to the activity, so that it can be presented for inspection. It must be used during the day in question, and cannot be returned or exchanged; the same applies to the various ancillary products.
Article 3 – Access to activities / Exclusion
The sale of a TICKET is open to any person who declares that he or she is in good moral and physical health, not subject to vertigo for the climbing courses, and has not consumed any substance likely to alter his or her behavior or alertness (alcohol, drugs, medication). The COMPANY reserves the right to exclude from the park any person holding an admission ticket who infringes the rules of safety and discipline, as well as any person who engages in behavior likely to hinder the normal practice of activities by other participants.
Article 4 – Purchase / Prior information
The acquisition of a TICKET implies the knowledge and acceptance by the person hereinafter referred to as the “CLIENT” or the “TICKET HOLDER” of the entirety of these general terms and conditions of sale and use, without prejudice to the usual means of recourse. It is the CLIENT’s responsibility to find out about the products and prices on offer (public prices displayed at points of sale and on the website) and to select the most suitable for him/her. The CUSTOMER is informed that certain offers are only available on the online sales site www.fun-parc-brumath.fr, this exclusivity being mentioned on the website. The COMPANY cannot be held responsible for the CLIENT’s choice. No claim or refund in this respect will be possible after purchase. The COMPANY reserves the right not to register a payment and not to confirm an order for any reason whatsoever, and more particularly in the event of difficulty concerning the order received.
Article 5 – Prices
Our ticket prices are quoted in euros, inclusive of all taxes (VAT and other taxes applicable on the date of order), unless otherwise indicated and exclusive of processing and shipping costs. All orders are payable in euros. The COMPANY reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the tariff in force at the time the order is validated and subject to availability. Please note: as soon as you take possession of the tickets ordered after purchase, the risks of loss or damage to the products are transferred to you.
Article 6 – Order validation
Any order placed on the https://fun-parc-brumath.fr website or on https://fun-parc-brumath.wakesys.com implies acceptance of these General Terms and Conditions. Any confirmation of an order implies full acceptance by the CLIENT of these General Terms and Conditions of Sale, without exception or reservation. All data supplied and the recorded confirmation shall constitute proof of the transaction. The CLIENT declares that he/she is fully aware of them. Confirmation of the order will constitute signature and acceptance of the operations carried out. A summary of the CLIENT’s order information will be sent to him/her via the order confirmation e-mail address.
Article 7 – Payment
Any issue of a TICKET will give rise to payment of the corresponding fee. These payments are made by bank card accepted by the COMPANY, or in cash in euros on site. The CLIENT is invited to purchase online. An online reservation will only be validated once the corresponding amount has been paid via the e-mail received. A confirmation e-mail with proof of payment will be sent to the CLIENT once the transaction has been finalized.
Article 8 – Entry conditions / Minimum age
Children will not be admitted to the following activities unless they meet the following conditions: – Be at least 3 years old and accompanied by an adult for the Trampolines; – Be at least 3 years old and at least 1 meter tall for the Accrobranche; – Be at least 6 years old and accompanied by an adult for the Aquapark and Waterjumps; – Be accompanied by an adult for the Aquapark and Waterjumps for children aged 6 to 12; – Be under adult supervision for the Aquapark and Waterjumps for children aged 12 to 16; – Must be over 7 years of age to use the water-ski lift; – Must be able to swim and immerse for all water activities; – Must be over 6 years of age and accompanied by an adult to use Soft Paintball; – Must be over 12 years of age and accompanied by an adult to use Paintball. In all cases, it is the responsibility of the child’s legal representative or the adult in charge of the child to certify that the child meets the above conditions. Whatever their age, minors are the responsibility of their parents or legal guardians, who are liable for any damage they may cause.
Article 9 – Cancellation and refund
In the event of rain or bad weather that does not require the park to be closed, the CLIENT is solely responsible for deciding whether or not to take part in the activity. In this case, no reimbursement will be made, even if the activity lasts less than one hour. If the CLIENT cancels the activity, the COMPANY will issue a credit note valid for 1 year. The COMPANY reserves the right to cancel the service in the event of unfavorable weather conditions presenting a risk for the practice of the activity. In the event of cancellation by the COMPANY, the CLIENT may postpone the activity, obtain a credit note or request reimbursement of any sums previously paid. Any other reason (exclusion for non-compliance with safety rules or internal regulations, endangerment of users, etc.) will not give rise to any refund, either in entry tickets or financial.
Article 10 – Exceptional circumstances
The following circumstances, with proof, do not incur a cancellation fee: serious illness or injury, hospitalization, accident, death or death of a close relative, positive test for COVID-19 or contact case.
Article 11 – Image rights
Any person accessing the site may be photographed for the purpose of illustrating brochures and commercial material. Access to the park implies full acceptance of the present rules and regulations, and releases the COMPANY from any legal proceedings relating to image rights.
Article 12 – Mediation procedure
After having referred the matter to the COMPANY, and in the absence of a satisfactory response within 1 month, the CUSTOMER may refer the matter to the Tourism and Travel Ombudsman, whose contact details are given below:
